Workplace Sexual Harassment in a post-Weinstein (-Cosby, -O’Reilly, -Lauer, etc.) World

Over a quarter century after the Clarence Thomas hearings, where workplace sexual harassment was first introduced into the national lexicon, it doesn’t actually seem like much has changed.  In 2016 alone, more than 25,000 claims of sex-based workplace harassment were filed with the U.S. Equal Employment Opportunity Commission.  That equates to roughly 70 sexual harassment claims being filed with the EEOC each and every day.  Perhaps more alarming, the EEOC estimates that three-fourths of people who are sexually harassed on the job don’t tell anyone.

Until now?

The never-ending wave of stories involving celebrities and politicians has sparked the #Me-too movement online.  Rest assured, these problems are not confined to Hollywood or Washington D.C., and the headlines being written today will — very soon — find their way to a workplace near you.  Now is the time, before it’s too late, for employers to scrutinize and reevaluate their approach to harassment training (assuming such training is even provided), policies, and the way in which expectations are communicated to employees.

Pillar+Aught Principal Kate Deringer Sallie will be presenting and serving as moderator of the “Top Commercial Cases of the Year” panel at the Pennsylvania Bar Institute’s 22nd Annual Bankruptcy Institute, which is being held on October 18, 2017 at the PBI Conference Center in Mechanicsburg.  This panel will address decisions over the last year that are of importance to attorneys with a commercial bankruptcy practice. Among the cases to be discussed will be opinions of the Supreme Court, the Third Circuit Court of Appeals, and other important decisions from outside the Third Circuit. Collaborate 2017 Conference

Two of Pillar+Aught’s attorneys, John Martin and Angela McGowan, have been named by the Central Penn Business Journal as 2017 “Forty Under 40” award recipients.  John and Angela join a number of their Pillar+Aught colleagues who have received this award in previous years, including Ken Rollins, Kate Sallie, and Todd Shill.

John is an experienced litigator who represents a variety of businesses in all aspects of employment law.  Upon graduating Summa Cum Laude from The Penn State Dickinson School of Law in 2006, John quickly developed a knack (and affinity) for representing employers and defending against claims of discrimination, harassment, and retaliation.  In addition to his litigation practice, John counsels and trains his clients on best practices to help address workplace challenges including how to: properly discipline employees; comply with EEO, ADA, and FMLA requirements; develop and implement effective policies; and enforce non-compete agreements.  He lectures frequently on a variety of topics including social media, wage and hour issues, and sexual harassment.

Angela represents Pillar+Aught business clients in the negotiation and execution of real estate transactions, with over a decade of experience in the purchasing, development and leasing of real estate. She also has significant experience in the oil and gas industry, having represented owners, operators, and landowners in the negotiation of pipeline easements, as well as leasing, acquisition, and zoning issues. A 2016 “Women of Influence” winner, Angela has been consistently recognized for her leadership within the legal profession and the community.

On July 19, 2017, Cory Iannacone and Lindsey Snavely Presented a Webinar for PSATS on Practical and Effective Strategies for Act 111 Police and Firemen Collective Bargaining Negotiations

Pillar+Aught Principals Cory Iannacone and Lindsey Snavely providing the PSATS audience with a “how to” presentation for implementing practical and effective strategies under Act 111.  The webinar included many exhibits from various interest arbitration hearings recently handled by Pillar+Aught.  Rather than simply telling the audience to “run numbers” or “prepare a worksheet,” Cory and Lindsey showed the audience exactly what to do by using their own worksheets from recent arbitration hearings.  One example was a police wage proposal for a 3.25% wage increase which, when cost out through an Excel spreadsheet incorporating the parties’ wage scale, actually equated to almost a 20% wage increase for certain officers in that year.  Cory and Lindsey also shared with the audience numerous maps, charts and graphs they have used in other interest arbitration hearings. The main takeaway from the webinar: know your numbers and be able to show them clearly and concisely through visual aids.

County Commissioners Association of Pennsylvania: Administrative Conference

Pillar+Aught Principals Cory A. Iannacone and Lindsey E. Snavely will present two sessions at the County Commissioners Association of Pennsylvania’s Administrative Conference which is being held this year at the Penn Stater Hotel and Conference Center in State College, Pennsylvania from May 31, 2017 through June 1, 2017.  The first session will cover workplace investigations and avoiding common pitfalls to save counties money.  The second session will cover employee discipline and how to make sure your discipline/termination sticks in the event of litigation.
