The Federal Credit Union Act gives federal credit unions the right to impose a lien on “the shares and dividends of any member, to the extent of any loan made to him and any dues or charges payable by him.”  The NCUA regulations provide the guidelines for credit unions wishing to create and impose a statutory lien on a member’s account.  The PA Credit Union Code grants a similar power to state-chartered credit unions. This can be a very effective and powerful tool when a member’s loan has gone delinquent.

 

Todd Shill will be presenting an employment and social media law update to members of the Adams County Bar Association and judiciary at their Bench Bar Conference on September 14, 2018 at the Liberty Mountain Resort, Fairfield PA.  This annual Conference is attended by legal professionals who practice in Adams, Franklin, and Fulton Counties.

Compliance with the U.S. Department of Treasury’s Customer Due Diligence (CDD) Final Rule is required by May 11, 2018. This rule is to further strengthen controls against money laundering, corruption, and tax evasion, as well as bring a greater sense of transparency within the financial system. The CDD rule compliments existing Bank Secrecy Act (BSA) regulations related to customer due diligence. During this webinar, Attorney Kate Deringer Sallie with the law firm Pillar+Aught will discuss the new requirements that credit unions must adhere to when opening and servicing business accounts.

Kate is the co-founder and principal of Pillar+Aught. She concentrates her practice in the areas of creditors’ rights, loan workouts, commercial lending transactions, and commercial bankruptcy. Kate represents financial institutions with respect to loan workouts, collection matters, lender liability actions, and as creditors in Chapter 7, 11 and 13 bankruptcy cases.  Kate is a Penn State University Dickinson School of Law graduate and continues her involvement at her alma mater by serving as a practitioner instructor.
